FORT LAUDERDALE – A Hollywood consumer alleges a debt that is not his is listed on his credit report.
Max Elimelech filed a complaint on Nov. 23 in the U.S. District Court for the Southern District of Florida against Experian Information Solutions Inc. and Collection Bureau of America LTD Inc. alleging violation of the Fair Debt Collections Practices Act and the Fair Credit Reporting Act.
According to the complaint, the plaintiff alleges that on March 30, he disputed an alleged debt that never belonged to him directly with the defendant with a dispute letter. He alleges that the defendant has not removed the credit account nor marked it as ''disputed by consumer'' despite being required to do so by the FDCPA. The plaintiff holds Experian Information Solutions Inc. and Collection Bureau of America LTD Inc. responsible because the defendants allegedly failed to correct erroneous personal information regarding the plaintiff after a reasonable request, and failed to promptly and adequately investigate information.
The plaintiff requests a trial by jury and seeks judgment against defendants, actual, statutory, and punitive damages, attorney's fees, costs, expenses and disbursements and further relief as the court may deem just. He is represented by Justin Zeig of Zeig Law Firm LLC in Hollywood.
