Adecco USA accused of violating woman's right to take medical leave

ORLANDO — A woman is suing Adecco USA Inc., a former employer, alleging violation of the Family and Medical Leave Act.

Yudisneisys Zaldivar filed a complaint on Nov. 21 in the U.S. District Court for the Middle District of Florida Orlando Division against Adecco USA Inc., alleging that the former employer violated her right to take a leave under the FMLA.

According to the complaint, the plaintiff alleges that in November 2014, she began working for the defendant, but at all times suffered from a serious medical condition, and that in March, she became pregnant and at the same time began experiencing health issues and subsequently submitted medical document to the defendant in support of her FMLA leave. On June 11, she alleges, her employment was terminated for absences that should have been protected by the FMLA. The plaintiff holds Adecco USA Inc. responsible because the defendant allegedly failed to notify plaintiff of her eligibility status and rights under the FMLA and interfered with her rights under FMLA by terminating her employment for repeated absences due to hospital visits.

The plaintiff requests a trial by jury and seeks judgment against the defendant, an injunction restraining continued violation, compensation for lost wages, benefits and other remuneration, reinstatement to a comparable prior position with back pay plus interest,pension rights and benefits, front pay, liquidated damages, costs, attorney's fees and further relief as the court deems just.
