Worker accuses Unum Life Insurance of ERISA violations

ORLANDO — A Florida man is suing Unum Life Insurance, alleging non-payment of insurance plan benefits.

Ioanis Bened filed a complaint Nov. 21 in U.S. District Court for the Middle District of Florida Orlando Division against Unum Life Insurance Company of America, alleging violation of the Employee Retirement Income Security Act (ERISA).

According to the complaint, Bened was covered under Unum's policies for long-term disability benefits, funded and administered by the defendant. However, the suit says, the defendant denied the plaintiff is entitled to premium benefits due to a disability, despite having subjected Bened to an unreasonable claims process.

The lawsuit states Bened has suffered monetary damages. The plaintiff alleges Unum Life Insurance failed to pay disability benefit payments, failed to properly and adequately investigate the merits of Bened's disability claim and failed to provide a full and fair review of his claim.

Bened seeks trial by jury, declaration he is entitled to insurance benefits, reinstatement of benefits, plus interest, court costs, attorney fees and all relief the court deems appropriate. He is represented by attorney William S. Coffman of Coffman Law in Tampa.
