Employee accuses Steak N Shake of failing to pay overtime

OSCEOLA — An Orlando woman is suing Steak N Shake, alleging unpaid overtime wages. 

Katherine Arteaga filed a lawsuit Nov. 23 in the Circuit Court of the Ninth Judicial Circuit of Florida against Steak N Shake Operations Inc., doing business as Steak N Shake, alleging violation of the Fair Labor Standards Act. 

According to the complaint, Arteaga worked as a waitress between March 1, 2010, and June 30, 2015, and then as a manager between July 1, 2015, and June 30, 2016, for more than 40 hours per week without being paid minimum wage or any overtime compensation by the Stake N Shake in Kissimmee, Florida, a violation of FLSA. 

Arteaga seeks trial by jury, liquidated damages, all unpaid wages, all monies contributed to an improper tip pool, all legal fees and all other relief the court deems just. She is represented by attorney Tammy Hammack of Cohen Grossman, Attorneys at Law in Maitland.
