TAMPA — A Pinellas County woman is suing United Airlines, alleging the defendant's negligence caused injuries to the plaintiff.
America Deupree filed a lawsuit Nov. 2 in Hillsborough County Circuit Court against United Airlines Inc., alleging failure to exercise reasonable care and caution for the safety of its passengers.
According to the complaint, on Oct. 22, 2014, Deupree was a passenger aboard Flight No. 339 from Tampa to Houston. The suit says while she was seated during the flight, a United employee accessed the overhead compartment directly above plaintiff to retrieve a box.
The lawsuit states the employee caused the heavy object to drop without warning and strike Deupree on the shoulder, causing the plaintiff serious bodily injury and physical pain, plus suffering, disability, disfigurement and scarring and aggravation of an existing condition.
The plaintiff alleges United stowed a heavy object in an improper location and in an unsafe manner, failed to protect Deupree from foreseeable harm and caused the unsecured cargo to drop creating a dangerous condition.
Deupree seeks trial by jury, damages of more than $15,000, plus costs of court and all other relief to which she is justly entitled. She is represented by attorneys Wil H. Florin and Thomas D. Roebig of Florin Roebig PA in Palm Harbor.
