Man alleges water-resistant Invicta Watch was damaged by water

MIAMI – A New York man has filed a class-action suit over allegations that a Hollywood business made false claims that its watches are suitable for use in water.

Jon B. Felice filed a complaint on behalf of all others similarly situated on Nov. 22 in the U.S. District Court for the Southern District of Florida against Invicta Watch Co. of America Inc. alleging violation of the Florida Deceptive and Fair Trade Practices Act and other counts.

According to the complaint, the plaintiff alleges that he suffered damages from purchasing a Pro Diver watch that was advertised as suitable for underwater wear. He alleges his watch no longer functions after wearing it while swimming in a pool and traveling on a boat. The plaintiff holds Invicta Watch Co. of America Inc. responsible because the defendant allegedly falsely represented its products to consumers that they are water resistant.

The plaintiff requests a trial by jury and seeks award actual damages plus interest, enjoin the defendant, all legal fees and any other relief as the court deems just. He is represented by Christopher S. Polaszek of The Polaszek Law Firm PLLC in Tampa and Jeffrey M. Norton and Roger A. Sachar Jr. of Newman Ferrara LLP in New York.
