Man claims Advanced Gastroenterology Associates violated wage laws

TAMPA — A man is suing B. Jeffrey Wallis, M.D., PA, d/b/a Advanced Gastroenterology Associates, and Jeffrey Wallis, claiming that the medical provider violated the Fair Labor Standards Act.

Dan Barajas filed a complaint on Nov. 2 in the U.S. District Court for the Middle District of Florida against the defendants, alleging that they wrongly failed to pay him an overtime premium.

According to the complaint, the plaintiff alleges that he began working for defendants in September 2013 as an office manager, a position he held until he resigned in December 2015 after not being paid weeks of wages. He alleges that in addition to missing that pay, he was not paid overtime for weeks in which he worked more than 40 hours. The plaintiff holds the defendants responsible for allegedly violating wage laws.

The plaintiff seeks judgment in his favor, unpaid overtime compensation, unpaid salary, attorneys’ fees and costs. He is represented by Mitchell L. Feldman of Lutz.
