FORT PIERCE – Two former laborers for a Vero Beach restaurant allege they were not paid overtime.
Juan Castro and Jose Diaz filed a complaint on Nov. 21 in the U.S. District Court for the Southern District of Florida against Theeratat & Preeda Corp. and Ampai Songbandit alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiffs allege that they worked for more than 40 hours per week without being paid any overtime compensation at the defendants' Sake Japanese & Thai Restaurant. The plaintiffs hold Theeratat & Preeda Corp. and Songbandit responsible because the defendants allegedly failed to pay the plaintiffs any overtime premiums of one-and-a-half times their regular rate.
The plaintiffs request a trial by jury and seek compensatory minimum wages, liquidated damages, all legal fees and any other relief as the court deems just. They are represented by Aaron Hines of Morgan & Morgan PA in Orlando.
