Employee alleges Liberty Mutual failed to pay proper benefits

MIAMI — A Florida woman is suing Liberty Life, alleging breach of contract in failing to pay disability benefits.

Tina Scott filed a lawsuit Nov. 17 in U.S. District Court for the Southern District of Florida Miami Division against Liberty Life Assurance Company of Boston, alleging violation of the Employee Retirement Income Insurance Act (ERISA). 

According to the complaint, in 2013, Scott became disabled and was initially approved to receive disability benefits from Liberty Life until they were terminated. The plaintiff alleges Liberty Life Assurance terminated her disability benefits despite the plaintiff still being disabled according to the terms of the plan.

Scott seeks unpaid disability benefits plus interest, all legal fees and all other relief the court deems just. She is represented by attorney Geannina Burgos of Wagar Dabdoub PA in Miami.
