FORT LAUDERDALE — A Florida man is suing his Broward County employers, alleging unpaid wages, violation of applicable minimum wage law and violation of workers compensation acts.
Johnnie Ray Miller Jr. filed a lawsuit Nov. 15 in U.S. District Court for the Southern District of Florida against Landamerica Holdings & Investments Group LLC, doing business as Landamerica Homes, Vincent T. Prince and Terry Coley, alleging failure to to compensate employees for all hours worked.
According to the complaint, Miller was employed by the defendants as a backhoe operator and laborer, However, the suit says, during Miller's employment the defendants failed to pay him the full and proper overtime wages of one and one half times his regular hourly rate and full and proper minimum wages as required by the Fair Labor Standards Act. The lawsuit says this caused the plaintiff to suffer monetary damages.
The plaintiff alleges the defendants denied the plaintiff his right to receive wages for every hour worked, and showed reckless disregard for the provisions of FLSA concerning the payment of minimum and overtime wages.
Miller seeks trial by jury, judgment for unpaid wages that are due, interest, attorney fees and court costs incurred, plus all relief the court deems just. He is represented by attorney Elliot Kozolchyk of Koz Law PA in Fort Lauderdale.
