MIAMI – A consumer alleges he was harassed by calls from a debt collector.
Johnny Sylvestre filed a complaint on Nov. 16 in the U.S. District Court for the Southern District of Florida against National Enterprise Systems Inc. alleging violation of the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that he suffered damages from receiving several unwanted phone calls on his cellular telephone from the defendant in an attempt to collect a debt. The plaintiff holds National Enterprise Systems Inc. responsible because the defendant allegedly used an automatic telephone dialing system to call plaintiff.
The plaintiff requests a trial by jury and seeks statutory damages of $1,500 or $500 for each and every violation, to enjoin the defendant, plus all legal fees and any other relief as the court deems just. He is represented by Yechezkel Rodal of Rodal Law PA in Dania Beach.
