Woman alleges Ocwen Loan Servicing continued to contact her after she settled debt

SARASOTA – A consumer alleges a debt collector continued to contact her after she settled a debt.

Stacey Mininsohn filed a complaint on Nov. 1 in the 12th Judicial Circuit Court of Florida - Sarasota County against Ocwen Loan Servicing LLC alleging violation of the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that on Feb. 24, 2014, she entered an agreement for full settlement of debt with the defendant as loan servicer for a home loan formerly owed by her. She alleges she performed all her obligations under the agreement, the defendant still contacted plaintiff to collect an already-satisfied debt, attempting to enforce a non-existing debt. The plaintiff holds Ocwen Loan Servicing LLC responsible because the defendant allegedly caused plaintiff to feel harassed and abused through frequent unsolicited calls, caused plaintiff to retain and pay for legal counsel and contacted plaintiff insisting on an unlawful debt.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages, costs of litigation, attorney's fees and other relief as the court deems fit. She is represented by Michael Alex Wasylik of Ricardo & Wasylik PL in Dade City.
