TAMPA – A St. Petersburg woman alleges a debt collector is harassing her with calls for a debt she does not owe.
Rosanna Garner filed a complaint on Oct. 31 in the Tampa Division for the Middle District of Florida against Terminix International Inc. alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.
According to the complaint, the plaintiff alleges that she has received more than more than 50 robocalls and pre-recorded messages from the defendant concerning a debt she does not owe. The plaintiff holds Terminix International Inc. responsible because the defendant allegedly called and left messages to plaintiff with such frequency meant to abuse or harass, contacted plaintiff without prior express consent and unlawfully utilized an automatic dialer or pre-recorded or artificial voice.
The plaintiff requests a trial by jury and seeks judgment against defendant, damages, costs, interest, attorneys' fees and any other such relief the court may deem just. She is represented by William Peerce Howard and Brandon J. Rafool of The Consumer Protection Firm PLLC in Tampa.
