Flowers Foods Inc. baked goods distributor alleges he was not paid overtime wages

TAMPA – A baked goods distributor alleges he was not properly compensated for overtime work.

Daniel Martins filed a complaint on behalf of behalf of others similarly situated on Nov. 8 in the U.S. District Court for the Middle District of Florida against Flowers Foods Inc., Flowers Baking Co. of Bradenton LLC and Flowers Baking Co. of Villa Rica LLC alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per workweek without being paid any overtime compensation. The plaintiff holds Flowers Foods Inc., Flowers Baking Co. of Bradenton LLC and Flowers Baking Co. of Villa Rica LLC responsible because the defendants allegedly failed to pay the plaintiff any overtime premiums at a rate of time-and-one-half for working more than 40 hours per week.

The plaintiff requests a trial by jury and seeks payment of all overtime hours, liquidated damages, all legal fees and interest plus any other relief as the court deems just. He is represented by Carlos V. Leach of Morgan & Morgan PA in Orlando and by Andrew R. Frisch in Plantation.
