MIAMI — A woman is suing Kentucky Higher Education Student Loan Corporation, a debt collector, citing alleged violation of telephone harassment statutes.
Esther Castro filed a complaint on Nov. 9 in the U.S. District Court for the Southern District of Florida Miami Division against Kentucky Higher Education Student Loan Corporation, claiming that the debt collector improperly called the plaintiff's cellular telephone in an attempt to collect an alleged debt.
According to the complaint, the plaintiff alleges that she suffered damages in connection with receiving several collection calls. The plaintiff holds Kentucky Higher Education Student Loan Corporation responsible because the defendant allegedly used an automatic telephone dialing system to call her cellular telephone.
The plaintiff requests a trial by jury and seeks statutory damages, an increase in the amount of the award to three times the amount, and any other relief as this court deems just. She is represented by Christopher W. Boss of Boss Law in St. Petersburg.
