MIAMI — A man has filed a class-action lawsuit against Portfolio Recovery Associates LLC, and Capital One Bank (USA), N.A., alleging violation of telephone harassment statutes.
Daniel Mather filed a complaint on Nov. 8 in the U.S. District Court for the Southern District of Florida against the defendants, claiming that they improperly called the plaintiff in an attempt to collect an alleged debt.
According to the complaint, the plaintiff alleges that he suffered damages from receiving several collection calls. The plaintiff holds the defendants responsible for allegedly using an automatic telephone dialing system.
The plaintiff requests a trial by jury and seeks statutory damages of $1,500 for each and every violation and any other relief as this court deems just. He is represented by George Andrews of Loan Lawyers LLC in Fort Lauderdale.
