JACKSONVILLE – A woman alleges her late husband did not receive timely treatment of cancer at the Lake City VA Medical Center.
Lucienne Taylor filed a complaint on Nov. 2 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against The United States of America alleging that the government failed to exercise standard care and skill required of medical providers and facilities.
According to the complaint, the plaintiff alleges that on Aug. 17, 2014, her husband, Robert Edgar Taylor, died from not receiving immediate treatment for carcinoma of the lung.
She alleges that as early as July 2013, a CT scan at Lake City VA Medical Center actually revealed a mass in his right lung, however, the medical staff did not report the critical imaging result, which she alleges deviates from appropriate standards of reasonable care. The plaintiff believes that the hospital is a facility owned and operated by the defendant and is held liable in the case she filed under the Federal Tort Claims Act (FTCA).
The plaintiff holds The United States of America responsible because the defendant allegedly failed to provide treatment to the decedent in a timely manner and failed to adequately train medical staff to appropriately report patients with critical test results.
The plaintiff requests a trial by jury and seeks judgment for damages and cost against defendant. She is represented by Fadi M. Chakour of Terrell Hogan in Jacksonville.
