JACKSONVILLE – A Glen St. Mary woman employed as a nurse alleges her long-term disability benefits were wrongfully terminated.
Lisa Conner filed a complaint on Nov. 1 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against Ascension Health and Sedgwick alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she was a participant in employees' benefits plan for long-term disability and continued to meet the definition of a disabled person under ERISA terms. However, on Nov. 27, 2015, the defendant allegedly upheld its decision to deny claims made by plaintiff, thereby causing her monetary losses.
The plaintiff holds Ascension Health and Sedgwick responsible because the defendants allegedly failed and refused to pay long-term disability benefits to plaintiff, and caused plaintiff to retain and pay for counsel fees.
The plaintiff requests a trial by jury and seeks judgment against defendant, unpaid disability benefits, interest, attorney's fees, costs of suit and further relief as the court deems just. She is represented by Erik Berger of Law Office of Erik W. Berger in Jacksonville.
