Woman claims Life Insurance Company of North America wrongly denied benefits

Insurance 09

JACKSONVILLE — A woman is suing Life Insurance Company of North America, a plan administrator, citing alleged violation of the Employee Retirement Income Security Act.

Kathleen Chambliss filed a complaint on Nov. 1 in the U.S. District Court for the Middle District of Florida against Life Insurance Company of North America, alleging that the plan administrator violated ERISA through non-payment of plan benefits.

According to the complaint, the plaintiff alleges that, on June 30, she became entitled to long-term disability benefits under the plan as a result of disabling medical conditions, however, she was denied benefits. The plaintiff holds Life Insurance Company of North America responsible because the defendant allegedly caused the plaintiff to retain and pay for legal counsel, and denied rightful benefits of the plaintiff to her disability claim.

The plaintiff requests a trial by jury and seeks judgment against the defendant, long-term disability benefits due and owing, interest, costs and attorney's fees. She is represented by Thomas M. Farrell of Farrell Disability Law in Jacksonville.
