MIAMI — A man is suing Jeffrey and Marcela Stern, parents of a minor, citing alleged assault, battery, negligence and intentional and negligent infliction of emotional distress.
Bryan Fried filed a complaint on Oct. 31 in the U.S. District Court for the Southern District of Florida against the defendants, alleging that they are responsible for life-threatening injuries, pain and suffering.
According to the complaint, the plaintiff alleges that on Oct. 31, 2015, he was a member of the Fraternity IFC, and was a resident of a fraternity house where the defendants' minor son was a guest. The paintiff approached the minor to escort him off a balcony and after repeatedly asking him to leave the balcony, the minor suddenly pushed and stuck the plaintiff and continued to strike and beat him until he was rendered unconscious, the suit states. As a result, he suffered serious injury and sustained severe personal injuries to his head, body and limbs which resulted in great pain, suffering and shock, the suit alleges.
The plaintiff holds Jeffrey and Marcela Stern responsible because their minor son allegedly acted negligently, recklessly and/or intentionally when he attacked and assaulted the plaintiff and failed to act in a proper and responsible manner toward plaintiff, and because they allegedly failed in their duties as parents and guardians to properly control, supervise, train, discipline and/or control the actions of a minor.
The plaintiff requests a trial by jury and seeks judgment against the defendants, compensatory and punitive damages in an amount in excess of $75,000. He is represented by Brad J. McCormick and Steven W. Cornman of Kubicki Draper PA in Miami.
