Woman alleges The Historic Hollywood Beach Resort wrongfully terminated her after injury

Wrongful term 13

FORT LAUDERDALE – A Broward County woman alleges she was wrongfully terminated from her position as housekeeper after she injured her finger on the job.

Jenille Coleman filed a complaint on Oct. 31 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Hollywood Beach Resort Rental Program LLC, doing business as The Historic Hollywood Beach Resort, citing the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that on Jan. 26, she sustained a work-related injury on her finger, which became infected and required medical treatment and surgery. She claims she immediately reported the injury and hospitalization to her immediate supervisors and that the defendant did not send her to a workers' compensation doctor/clinic and/or explain her rights under the law protecting injured employees afflicted with a serious health condition. She alleges she was terminated on Feb. 20.

The plaintiff holds Hollywood Beach Resort Rental Program LLC responsible because the defendant allegedly failed to notify plaintiff of her eligibility status and rights under the FMLA and failed to notify plaintiff whether her leave was or could be designated as FMLA leave.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages, back pay/front pay, interest, costs, attorney's fees and further relief as the court deems just. She is represented by R. Martin Saenz of Saenz & Anderson PLLC in Aventura.
