Former WP Enterprises of Florida employee alleges he was misclassified, owed overtime

ORLANDO – A former parts manager for a Volusia County employer alleges he was incorrectly classified as an employee and was not paid overtime wages.

James Kendall filed a complaint on Oct. 31 in the U.S. District Court for the Middle District of Florida, Orlando Division against WP Enterprises of Florida LLC and William Perretti Jr. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid any overtime compensation from January to June. The plaintiff holds WP Enterprises of Florida LLC and Perretti Jr. responsible because the defendants allegedly failed to pay plaintiff any overtime premiums because he was incorrectly classified as an exempt employee.

The plaintiff requests a trial by jury and seeks unpaid overtime compensation, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by C. Ryan Morgan of Morgan & Morgan PA in Orlando.
