TAMPA – A former beach attendant for a South Pasadena business alleges it used unlawful pay practices.
Garin Crosson filed a complaint on Oct. 17 in the Tampa Division of the Middle District of Florida against Suncoast Watersports LLC and David Winkler alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he was employed by the defendants from February through July. He alleges that during his period, he was not paid overtime for working more than 40 hours per week and that the defendant did not withhold taxes or make payments to Social Security.
The plaintiff holds Suncoast Watersports LLC and David Winkler responsible because the defendants allegedly engaged in the practice of violating the overtime provisions of the FLSA and misclassified plaintiff as an independent contractor.
The plaintiff requests a trial by jury and seeks judgment against defendants, damages, interest, attorney's fees and further relief as the court deems just. He is represented by Peter L. Tragos of Law Offices of Tragos & Sartes PL in Clearwater.
