TAMPA — An individual is suing Aetna Life Insurance Co., an insurer, citing alleged breach of contract.
David Rinehart filed a complaint on Oct. 17, in the U.S. District Court for the Middle District of Florida against Aetna Life Insurance Co. alleging that the insurer violated ERISA through non-payment of plan benefits.
According to the complaint, the plaintiff alleges that he is entitled to recover long-term disability insurance benefits on a monthly basis for having met the applicable definition of total disability described under ERISA, for his various debilitating conditions. However, the defendant upholds its decision to deny benefits to plaintiff.
The plaintiff holds Aetna Life Insurance Co. responsible because the defendant allegedly caused plaintiff to retain and pay for legal counsel to recover his disability benefits and breached its fiduciary duty as claims administrator to uphold plaintiff's rights to his long-term disability benefits.
The plaintiff requests a trial by jury and seeks judgment against defendant for all relief that may be available to him, plus costs, attorney's fees and further relief as the court deems appropriate. He is represented by Marcus A. Castillo of Haas & Castillo in Clearwater.
