A photographer accuses CheapCaribbean.com of using his photos without permission

ORLANDO — A photographer is suing CheapCaribbean.com, a Florida corporation, citing alleged copyright infringement.

Jorge Ramirez filed a complaint on Oct. 20, in the U.S. District Court for the Middle District of Florida Orlando Division against CheapCaribbean.com alleging that the Florida corporation violated laws by unauthorized distribution of an intellectual property.

According to the complaint, the plaintiff alleges that he is the author and copyright owner of the two photographic works that was discovered to have been infringed by the defendant by reproducing and displaying the photographs in a public place, to promote its business without permit or consent from plaintiff. Thereby, the plaintiff has suffered substantial monetary damages and other irreparable harm. 

The plaintiff holds CheapCaribbean.com responsible because the defendant allegedly failed to acquire consent from plaintiff before using subject photographs, and prepared derivative works of the photographs and distributed them to the public to market its for-profit business.

The plaintiff requests a trial by jury and seeks judgment in its favor, to enjoin defendant from further infringement, destroy all infringing copies, damages in the amount of $150,000 per infringed work, attorneys' fees, costs, and further relief as the court deems just. He is represented by David F. Tamaroff of Tamaroff Law PA in Miami.
