Woman claims she was wrongfully terminated when she asked for overtime wages

ORLANDO — A woman is suing Insight Behavioral Health Specialists LLC, former employer, citing alleged breach of contract, retaliation, unjust enrichment and unpaid overtime wages.

Brenda Vazquez filed a complaint on Oct. 20, in the U.S. District Court for the Middle District of Florida against the defendants alleging that they failed their duties to pay employees for all hours worked at a correct rate.

According to the complaint, the plaintiff alleges that, from November 23, 2015 through April 19, she had worked for the defendants as a non-exempt employee and engaged in an implied agreement with the defendants to be properly paid for all hours worked. However, she was not paid at the proper overtime rate for hours worked beyond 40 hours per week. Consequently, she was terminated for repeatedly complaining about this practice.

The plaintiff holds Insight Behavioral Health Specialists LLC responsible because the defendants allegedly failed to post notice informing employees of their federal rights to overtime and minimum wage payment, failed to provide the proper wages and retaliated by adversely terminating plaintiff's employment.

The plaintiff requests a trial by jury and seeks judgment in her favor, back wages, front wages until 65 years of age, compensatory damages, attorneys' fees and further relief as the court deems just. She is represented by Peter M. Hoogerwoerd and Waynice A. Green of Remer & Georges-Pierre PLLC in Miami.
