Balfour Beatty Construction files interpleader in court over subcontractor payments

ORLANDO – A general contractor for a Walt Disney World resort project is seeking the court's help regarding payment of subcontractors.

Balfour Beatty Construction LLC filed a complaint for interpleader on Oct. 18 in the U.S. District Court for the Middle District of Florida Orlando Division against Lake Mechanical Contractors Inc., New Era Lending LLC, Fast Tec Inc., et al.

According to the complaint, the plaintiff alleges that it was the general contractor for a pool rehabilitation project at the Walt Disney World Polynesian Resort and contracted Lake Mechanical as subcontractor. The suit states Lake Mechanical hired several contractors for the project, now part of the defendants in this case, and those subcontractors have completed their work on the project. The plaintiff alleges Lake Mechanical failed to pay its subcontractors or other defendants in full and the plaintiff holds $102,590.25 as funds supposedly for payment and as retainage for Lake Mechanical, but cannot decide on how to allocate the funds without risk of exposing itself to double liability.

The plaintiff seeks to restrain and enjoin defendants from proceeding with any action against the plaintiff for recovery of the funds, permit plaintiff to pay funds into the registry of the court, discharge it from further liability, award costs, attorney's fees and further relief as the court deems just.
