Tiffany alleges counterfeit goods infringe on trademark

FLORIDA — A high profile jeweler is suing a list of business entities, citing alleged unfair competition.

Tiffany (NJ) LLC filed a complaint on Oct. 20, in the U.S. District Court for the Southern District of Florida against a long list of unidentified defendants alleging that they distribute counterfeit copies of the jeweler's products.

According to the complaint, Tiffany alleges it suffered damages to its business. The plaintiff holds the individuals, partnerships, and unincorporated associations behind a long list of websites  responsible because the unidentified defendants allegedly promote and advertise for sale of confusingly similar products that bear the plaintiff's trademark.

The plaintiff seeks to enjoin the defendants from further infringing upon the plaintiff's trademark, transfer the domain names used by the defendants to the plaintiff's control, award all damages and profits to the plaintiff, statutory damages in the amount of $2 million per each counterfeit trademark, all profits and damages and statutory damages in the amount of $100,000 per cybersquatted domain name, all legal fees and interest plus any other relief this court deems just.
