Philippines film company sues pirate websites that allegedly stream its work

FLORIDA — A Philippines corporation is suing The Individual, Partnership, or Business Association Identified as FMovies.to, foreign business entity, citing alleged copyright infringement and unfair competition.

ABS-CBN Corp., ABS-CBN Film Productions, Inc. d/b/a Star Cinema, and ABS-CBN International Corp. filed a complaint on Oct. 20, in the U.S. District Court for the Southern District of Florida against the defendants alleging that they offer streaming services of the plaintiff's work.

According to the complaint, the plaintiffs allege that ABS-CBN Corp., ABS-CBN Film Productions, Inc. d/b/a Star Cinema, and ABS-CBN International Corp. suffered damages to their business. The plaintiffs holds The Individual, Partnership, or Business Association Identified as FMovies.to responsible because the defendants allegedly operate pirate websites that offer pay per view programming of plaintiff's TV and movie content.

The plaintiffs seek to enjoin the defendant from further infringing plaintiff's works, transfer the subject domain name used by the defendant to the plaintiff's control, award all damages to the plaintiff including profits derived from the unlawful act, statutory damages, all legal fees and any other relief as this court deems just. They are represented by Stephen M. Gaffigan, Virgilio Gigante and Christine Ann Daley of Stephen M. Gaffigan, P.A. in Ft. Lauderdale.
