Universal Polygram and EMI April Music Inc. sue over alleged copyright infringement

FLORIDA — A music production company is suing Mercato 2401, Inc. and Carmine Giardini, Florida corporation, citing alleged copyright infringement.

Universal Polygram International Publishing, Inc., EMI April Music Inc., and Palm Valley Music, L.L.C. filed a complaint on Oct. 18, in the U.S. District Court for the Southern District of Florida against the defendants alleging that they used plaintiff's musical works in public performances without a proper license from plaintiff.

According to the complaint, the plaintiffs allege that Universal Polygram International Publishing, Inc., EMI April Music Inc., and Palm Valley Music, L.L.C. suffered damages from having their musical compositions used without their consent. The plaintiffs holds Mercato 2401, Inc. and Carmine Giardini responsible because the defendants allegedly refused all of plaintiff's attempts to offer a license for their works.

The plaintiffs seek to enjoin and restrain the defendant, statutory damages to the plaintiff in an amount not more than $30,000 but not less than $750, all legal fees and any other relief as this court deems just. They are represented by Frederick D. Page of Holland & Knight LLP in Jacksonville.
