Man alleges Virginia health, insurance provider sent him unsolicited text messages

MIAMI – A class-action suit has been filed against a Virginia health insurance and managed care provider over allegations it sent unsolicited text messages to solicit its services.

Tracy Harris filed a complaint on behalf of all others similarly situated on Oct. 12 in the U.S. District Court for the Southern District of Florida against Amerigroup Corp. citing the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in 2015, he received unwanted text messages from the defendant when he has never been a customer. He alleges he contacted the defendant to request that the texts stop, but he still continues to receive messages. The plaintiff holds Amerigroup Corp. responsible because the defendant allegedly used an automatic telephone dialing system to contact plaintiff.

The plaintiff requests a trial by jury and seeks statutory damages of $500 for every violation, treble damages of $1,500 for every violation, injunction against the defendant, all legal fees and any other relief the court deems just.
