Synchrony Bank alleged to have continued to call consumer after asked to stop

OCALA – An Ocala consumer alleges a debt collector contacted her 250 times since she requested that it stop calling her.

Marisa Brady filed a complaint on Oct. 11 in the U.S. District Court for the Middle District of Florida, Ocala Division against Synchrony Bank alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that in November 2015 she began receiving calls from the defendant on her cellular telephone in an attempt to collect an alleged debt. Despite asking the defendant in February to cease calling her and email her instead, the defendant allegedly continued calling her, thereby causing plaintiff to suffer from unavailability of her phone line for legit calls, waste of her time, emotional distress and invasion of privacy. 

The plaintiff holds Synchrony Bank responsible because the defendant allegedly contacted plaintiff with intent to harass and abuse and for using an automatic telephone dialing system.

The plaintiff requests a trial by jury and seeks judgment in her favor, damages, costs, attorney's fees, enjoinder from further violations and further relief as the court may deem just. She is represented by Shaughn C. Hill of Morgan & Morgan in Tampa.
