Georgia lawyer accused of extortion by CMA of Delaware, National Beverage Corp.

FORT LAUDERDALE – Two Broward County businesses allege a Georgia lawyer attempted to extort money from them with a series of lawsuits.

CMA of Delaware Inc. and National Beverage Corp. filed a complaint on Oct. 7 in the U.S. District Court for the Southern District of Florida against David B. Mursten, John and Jane Does and John Doe corporations alleging breach of confidentiality and nondisclosure agreement, breach of fiduciary duty and other counts.

According to the complaint, the plaintiffs allege that on Aug. 21, 2006, CMA of Delaware Inc. and National Beverage Corp. entered a confidentiality agreement with Mursten that gave him access to significant amounts of confidential and privileged information belonging to plaintiffs for providing assistance in legal matters.

The suit states that Mursten filed several lawsuits against plaintiffs, disclosing confidential information about the plaintiffs in clear violation of the confidentiality agreements executed by him and without the knowledge of NBC or CMA. The suit states that when Mursten's plan to extort money failed, he filed for bankruptcy to evade paying judgment of $350,000.

The plaintiffs hold David B. Mursten, John and Jane Does and John Doe corporations responsible because the defendants allegedly filed a lawsuit against plaintiff CMA in an attempt to extort money for himself through baseless lawsuits premised on false allegations, failed to fully respond to demands of plaintiffs and to comply with legal obligations for the immediate return of all of plaintiffs' documents, records and materials.The plaintiffs request a trial by jury and seek judgment against defendants, restraining order, damages, interest, attorney's fees and costs. They are represented by Glenn J. Waldman of Waldman Trigoboff Hildebrandt Marx & Calnan PA in Fort Lauderdale.
