Paralegal seeks reinstatement to disability benefits from Guardian Life

MIAMI – A paralegal alleges her claim for disability benefits was wrongfully denied.

Karen Ray filed a complaint on Oct. 7 in the U.S. District Court for the Southern District of Florida against The Guardian Life Insurance Co. of America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she became disabled and applied for disability benefits in 2013 but was denied. She alleges she was granted benefits after an appeal, but the benefits were terminated in July 2015. The plaintiff holds The Guardian Life Insurance Co. of America responsible because the defendant allegedly failed to properly and adequately investigate her claims and provide a fair and full review.

The plaintiff seeks payment of disability benefits due to plaintiff, reinstatement to the plan, all legal fees and interest and any other relief the court deems just. She is represented by Stephen F. Jessup of Attorneys Dell and Schaefer Chartered in Hollywood.
