MIAMI – A New York boutique operator alleges several online sellers are offering counterfeit versions of its luxury goods.
Gucci America Inc. filed a complaint on Oct. 10 in the U.S. District Court for the Southern District of Florida against ACS Connect, Amous design, Bottle Glass design, et al. alleging trademark infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business from having its products copied and sold to consumers. The plaintiff holds ACS Connect, Amous design, Bottle Glass design, et al. responsible because the defendants allegedly sold counterfeit goods bearing plaintiff's trademarks online on Amazon, eBay and other websites.
The plaintiff seeks to enjoin the defendants from further infringing plaintiff's trademark, pay plaintiff for all damage and profits derived from the infringement of their trademark, all legal fees, and any other relief the court deems just.
