Man files suit against Citibank over alleged frequency of collection calls

MIAMI – A South Dakota debt collector is alleged to have violated state and federal laws in an attempt to collect an alleged debt from a consumer.

Wilfred Mondestin filed a complaint on Oct. 7 in the U.S. District Court for the Southern District of Florida against Citibank NA alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that beginning in January, the defendant contacted him in an attempt to collect a purported debt from a Home Depot credit card account. The plaintiff holds Citibank NA responsible because the defendant allegedly frequently used an automatic telephone dialing system to contact plaintiff.

The plaintiff requests a trial by jury and seeks statutory damages of $1,500 for each violation, enjoin the defendant, and any other relief as the court deems just. He is represented by George Andrews of Loan Lawyers LLC in Fort Lauderdale.
