MIAMI – A Miami-Dade County consumer alleges erroneous information was reported on her credit report.
Carol V. Triminio filed a complaint on Sept. 27 in the U.S. District Court for the Southern District of Florida, Miami Division against TD Retail Card Services and Trans Union LLC citing the Florida Consumer Collection Practices Act and the Fair Credit Reporting Act.
According to the complaint, the plaintiff alleges that in 2016 her identity was stolen and she received a letter from TD Retail for a bill of $5,679.98. She alleges she reported to TD Retail that she did not owe the balance because her identity was stolen, but that the defendant continued to attempt to collect the debt and reported the negative amount on her credit report.
The plaintiff holds TD Retail Card Services and Trans Union LLC responsible because the defendants allegedly failed to correct plaintiff's credit history despite knowing that plaintiff does not owe any debt from her written disputes.
The plaintiff requests a trial by jury and seeks actual damages, statutory damages, all legal fees and any other relief as the court deems just. She is represented by Christopher W. Legg and Matthew Buchwald of Buchwald Legg PLLC in Hollywood.
