Lee County man alleges he was injured because of another cyclist's negligence

FORT MYERS – A Lee County cyclist alleges he was injured when another cyclist traveled into his path.

Thomas Foley filed a complaint on Oct. 6 in the 20th Judicial Circuit of Florida - Lee County against Ryan Stewart and Stephen Stewart alleging negligence.

According to the complaint, the plaintiff alleges that on March 10, 2013, he was riding a bicycle on a path near Sanibel Captiva Road, when he approached the defendants, who were also on bicycles, and announced he was passing on the left. The suit states that as the plaintiff was passing, Ryan Stewart moved his bicycle into his path of travel, which caused him to collide with plaintiff. As a result, the plaintiff alleges suffered permanent physical injury, disability, impairment, mental anguish, medical expenses, loss of ability to enjoy normal life and damaged his bicycle.

The plaintiff requests a trial by jury and seeks judgment against defendants of more than $15,000, interest, costs and other relief as the court deems just. He is represented by Chad T. Brazzeal of Morgan & Morgan in Fort Myers.
