TAMPA – A soil tester has filed a class-action suit against a Pinellas County employer alleging he and other employees were not properly compensated for overtime work.
Christopher Yarger filed a complaint on behalf of himself and others similarly situated on Oct. 3 in the Tampa Division of the Middle District of Florida against Central Florida Testing Laboratories Inc. alleging that the foreign corporation breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that he worked for the defendant as an hourly worker and non-exempt employee but was not paid for all hours that he worked during a workweek. He also alleges the defendant did not keep accurate time records.
The plaintiffs hold Central Florida Testing Laboratories Inc. responsible because the defendant allegedly failed to pay overtime wages at a rate of time-and-one-half.
The plaintiff requests a trial by jury and seeks judgment against defendant, unpaid wages, liquidated damages, attorneys' fees, costs of suit and further relief as the court deems just. He is represented by W. John Gadd of The Law Office of W. John Gadd in Clearwater.
