Woman claims Community Based Care of Central Florida wrongfully terminated her

Wrongful term 08

ORLANDO – An Orange County woman alleges she was wrongfully terminated for taking a medical leave.

Jill Gentry filed a complaint on Oct. 3 in the U.S. District Court for the Middle District of Florida, Orlando Division against Community Based Care of Central Florida Inc. alleging violation of the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that she began working for the defendant as executive director for Seminole County in March 2011. On May 6, 2015, she allegedly was diagnosed with chest pain, Barrett's esophagus, radiculitis, stress reaction and hypertension. She requested FMLA leave, which was approved on May 27, 2015. The suit states that her physician recommended working no more than 40 hours per week from July 2015 to May. She alleges that she was terminated from her position in retaliation for exercising her right to FMLA leave.

The plaintiff requests a trial by jury and seeks judgment and recovery against defendant pursuant to the FMLA. She is represented by Thomas Eross Jr. of The Ticktin Law Group PLLC in Deerfield Beach.
