TAMPA – The manufacturers of Ray-Ban and Oakley sunglasses allege a Florida retailer is selling counterfeit products.
Luxottica Group S.p.A. and Oakley Inc. filed a complaint on Sept. 29 in the Tampa Division for the Middle District of Florida against Neighborhood Financial Group LLC, doing business as Quick Cash Pawn alleging trademark infringement.
According to the complaint, the plaintiffs allege that on July 21, 2016, their investigator visited defendant's retail store and discovered that defendant was distributing, advertising, publicly displaying, and/or selling sunglasses bearing logos and source-identifying indicia and design elements that are imitations of the Ray-Ban and Oakley Brands. They claim the defendant has no license or authority from Luxottica Group or Oakley to use any of the trademarks.
The plaintiffs hold Neighborhood Financial Group LLC, doing business as Quick Cash Pawn, responsible because the defendant allegedly deceived consumers to believe that the counterfeit products are authentic and authorized products by the plaintiffs and introduced counterfeit and inferior products into the stream of commerce.
The plaintiffs request a trial by jury and seek judgment against defendant, permanent injunction, damages, costs, attorney's fees, investigatory fees, expenses, interest and further relief as the court deems just. They are represented by David B. Rosemberg of Broad and Cassel in Miami.
