MIAMI – A Broward County consumer is suing Nevada-based debt collector over allegations it sent a collection letter with incomplete information regarding a debt.
Joan Williams filed a complaint on Oct. 2 in the U.S. District Court for the Southern District of Florida against First National Collection Bureau Inc. alleging violation of the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.
According to the complaint, the plaintiff alleges that in August she received a collection letter from the defendant for a debt that she defaulted on more than five years ago and requested that she enter into a payment plan. The plaintiff holds First National Collection Bureau Inc. responsible because the defendant allegedly failed to advise plaintiff that making a payment would revive the statute of limitations on the debt and give the defendant the ability to sue over the debt.
The plaintiff requests a trial by jury and seeks statutory and actual damages, injunction against the defendant, all legal fees and any other relief as the court deems just.
