MIAMI – A record label that acquires music catalogs alleges a New York company claims it owns the copyrights to compositions it acquired.
Essential Media Group LLC filed a complaint on Oct. 4 in the U.S. District Court for the Southern District of Florida against 43 North Broadway LLC alleging copyright infringement.
According to the complaint, the plaintiff alleges that it acquired the Everest Catalog of Recordings in 2004 and spent more than $150,000 remastering the recordings for commerce, creating copyrightable derivative versions.
The plaintiff holds 43 North Broadway LLC responsible because the defendant allegedly is selling the derivative works and has illegally informed vendors it owns the exclusive rights to the copyrights.
The plaintiff seeks compensatory damages, special damages, and any other relief as this court deems just. It is represented by Richard C. Wolfe of Wolfe Law Miami PA in Miami.
