Consumer claims Springleaf called 1,000 times to collect alleged debt

JACKSONVILLE – A Nassau County woman alleges a debt collector harassed her with approximately 1,000 calls in two years.

Virginia Long filed a complaint on Oct. 3 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against Springleaf Finance Inc. violation of the Telephone Communication Act.

According to the complaint, the plaintiff alleges that sinceJan. 27, 2014, the defendant has called her 1,000 times in its attempt to collect an alleged debt. She alleges that the defendant's calls were made using an automatic telephone dialing system or an artificial or pre-recorded voice, causing plaintiff to suffer from occupation of her phone line, unavailability of phone for legitimate calls, wasted time, annoyance, embarrassment, distress, distraction and trespass upon her chattels. 

The plaintiff holds Springleaf Finance Inc. responsible because the defendant allegedly contacted plaintiff with such frequency meant to harass and abuse, utilized an autodialer or an artificial/pre-recorded voice and continued to call plaintiff despite her demands to cease calling her.

The plaintiff requests a trial by jury and seeks judgment against defendant, statutory damages, punitive damages, actual damages, costs, interest, attorney's fees, enjoinder from further violations and other relief as the court may deem just.
