YULEE – A Fernandina Beach man alleges a tree stand he that purchased broke and caused him injuries.
Robin Turner filed a complaint on Oct. 3 in the 4th Judicial Circuit Court - Nassau County against Wal-Mart Stores East LP alleging that the retail store breached its duty to exercise due care in distributing product in commerce.
According to the complaint, the plaintiff alleges that on Sept. 10, 2012, he purchased a tree stand from the defendant. He alleges that when he attempted to use the tree stand for hunting, it snapped from the cables and caused him to fall 20 feet to the ground. He alleges he suffered from permanent physical injury that resulted to pain and suffering, disability, loss of earnings and loss of capacity for the enjoyment of life, and that he also incurred substantial expenses from hospitalization and nursing care.
The plaintiff holds Wal-Mart Stores East LP responsible because the defendant allegedly warranted that the tree stand was merchantable and introduced a defective product into the stream of commerce.
The plaintiff requests a trial by jury and seeks judgment for damages against defendant of more than $15,000 plus costs. He is represented by Christopher W. Hewett of The Law Office of Nooney & Roberts in Jacksonville.
