Woman alleges Champion Painting Specialty Services Corp. denied overtime pay

MIAMI – A Palm Beach County woman who was formerly employed as a project coordinator claims she was unlawfully denied payment of overtime ages.

Christine Miserendino filed a complaint on Sept. 29 in the U.S. District Court for the Southern District of Florida against Champion Painting Specialty Services Corp. and Carlos M. Hernandez alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between June 2013 and March, she worked for more than 40 hours per week without being paid any overtime compensation. The plaintiff holds Champion Painting Specialty Services Corp. and Hernandez responsible because the defendants allegedly refused to pay overtime premiums at a rate of time-and-one-half to the plaintiff for working more than 40 hours per week.

The plaintiff requests a trial by jury and seeks liquidated damages, all legal fees and any other relief as the court deems just. She is represented by Michelle Cohen Levy of The Law Office of Michelle Cohen Levy PA in Fort Lauderdale.
