MIAMI – A forklift operator alleges his former Miami-Dade County employers did not pay a minimum wage or overtime wages.
Jesus R. Morales-Ortega filed a complaint on behalf of other similarly situated individuals on Sept. 29 in the U.S. District Court for the Southern District of Florida, Miami Division against Unique Freight Lines Inc., Roadtex Transportation Corp. and David Padron alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he worked for an average of 80 hours per week without being paid any overtime compensation or the legal minimum wage. The plaintiff holds Unique Freight Lines Inc., Roadtex Transportation Corp. and Padron responsible because the defendants allegedly failed to pay plaintiff any overtime premium for hours worked that exceeded 40 hours or a minimum wage.
The plaintiff requests a trial by jury and seeks actual damages, unpaid minimum wages, unpaid overtime compensation, double damages/ liquidated damages, all legal fees and any other relief as this court deems just.
