Woman alleges staffing agencies interfered with FMLA rights

TAMPA – A woman formerly employed by a Tampa staffing agency alleges the employer failed to notify her of her eligibility to take a leave for her pregnancy.

Liset Delgado filed a complaint on Sept. 28 in the Tampa Division for the Middle District of Florida against Select Staffing LLC, Real Time Staffing Services LLC and Employbridge LLC alleging violation of the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that she requested maternity leave in December 2015. She alleges she was told by the defendants that she needed to re-apply for her position upon her return from maternity leave, which in effect terminated her employment with the defendants.

The plaintiff holds Select Staffing LLC, Real Time Staffing Services LLC and Employbridge LLC responsible because the defendants allegedly failed to notify plaintiff of her eligibility to take FMLA leave, terminated plaintiff by requiring her to re-apply to her position and interfered with the exercise of plaintiff's rights under the FMLA.

The plaintiff requests a trial by jury and seeks judgment against defendants, compensation for lost wages and benefits, reinstatement to prior or comparable position with back pay plus benefits, damages, front pay, interest, costs, attorney's fees and further relief as the court deems just. She is represented by Luis A. Cabassa of Wenzel Fenton Cabassa PA in Tampa.
