Michigan woman alleges she was injured while traveling on tender

MIAMI – A Michigan woman alleges she was injured in a shore excursion in the Bahamas because the tender she was traveling in was overloaded.

Karen Wiemuth filed a complaint on Sept. 27 in the U.S. District Court for the Southern District of Florida, Miami Division against Carnival Corp., Blue Illusions and/ or Admiralty Marine & Port Services and Carib Resorts Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 30, 2015, she suffered physical injuries from being thrown to the deck of the tender due to harsh weather conditions from Tropical Storm/Hurricane Joaquin. The plaintiff holds Carnival Corp., Blue Illusions and/or Admiralty Marine & Port Services and Carib Resorts Inc. responsible because the defendants allegedly failed to provide adequate assistance or safety features in order to make sure that plaintiff was safe while standing inside the tender.

The plaintiff requests a trial by jury and seeks compensatory damages, interest, and any other relief as the court deems just. She is represented by Joel M. Barnett of Waks & Barnett PA in Miami.
