Consumer claims Ocwen Loan Servicing LLC invaded privacy

MIAMI – A consumer claims a debt collector invaded her privacy with several calls to her cellphone.

Cynthia D. Jacobs filed a complaint on Sept. 27 in the U.S. District Court for the Southern District of Florida against Ocwen Loan Servicing LLC alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff claims that in 2015, the defendant called her hundreds of times in an attempt to collect an alleged debt. The plaintiff holds Ocwen Loan Servicing LLC responsible because the defendant allegedly used an automatic telephone dialing system to contact plaintiff.

The plaintiff requests a trial by jury and seeks statutory damages of $1,500 for each and every violation of the TCPA, enjoin the defendant, and any other relief as the court deems just. She is represented by George N. Andrews of Loan Lawyers LLC in Fort Lauderdale.
